General Terms and Conditions (GTC) for the craft business "Handwaerk"

1. Scope
The following terms and conditions govern the contractual relationship between the craft business "Handwaerk" (hereinafter referred to as "Contractor") and its customers (hereinafter referred to as "Client"). Any differing terms and conditions of the Client are not recognized unless the Contractor expressly agrees to them in writing.

2. Offer and conclusion of contract
2.1. The contractor's offers are non-binding and subject to change.
2.2. The contract is concluded by the contractor's written order confirmation or by the contractor commencing work.

3. Scope of Services
3.1. The exact scope of services is defined in the order confirmation or the order.
3.2. Any changes or additions to the order require a written agreement between the contracting parties.
3.3. The contractor is entitled to use subcontractors to fulfill its obligations.

4. Prices and Payment Terms
4.1. Unless otherwise agreed, prices are in euros and exclude statutory value added tax.
4.2. Payment of the agreed price is due within 14 days of invoicing without deduction, unless otherwise agreed.
4.3. In the event of late payment by the client, the contractor is entitled to demand default interest at a rate of 5 percentage points above the base interest rate.

5. Dates and deadlines
5.1. Agreed dates and deadlines are generally non-binding unless they are expressly marked as binding.
5.2. The contractor is entitled to provide and invoice partial services.

6. Warranty and Liability
6.1. The contractor warrants that the services provided are free from defects and meet the agreed requirements.
6.2. The client must report any defects in writing immediately, but no later than 14 days after acceptance.
6.3. The contractor is liable for damages only in cases of gross negligence or intent.
6.4. The contractor shall only be liable for slight negligence in the event of a breach of essential contractual obligations.

7. Data protection
The contractor undertakes to comply with data protection regulations. Personal data will be treated confidentially and used only for the purpose of fulfilling the contract.

8. Final Provisions
8.1. The law of the Federal Republic of Germany applies.
8.2. Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
